Intellectual Property

The Site as a whole, as well as each of its individual components (including but not limited to texts, diagrams, structures, software, animations, images, photographs, illustrations, videos, graphical or editorial representations, logos, etc.) constitute intellectual works protected by the Intellectual Property Code and any other applicable international legislation.

Only the company itself (directly or through licenses or authorizations) is authorized to use the elements comprising the site, domain names, trademarks, designs, etc., as well as the images and editorial content reproduced therein.

The use of all or part of the Site, particularly by downloading, reproducing, transmitting, representing, or disseminating it for purposes other than personal and private consultation and use by the user for non-commercial purposes is strictly prohibited. Violating these provisions exposes the offender to the sanctions provided by the Intellectual Property Code, particularly for copyright infringement, trademark rights, and by the Civil Code regarding civil liability.

Site Availability

The company strives, as far as possible, to maintain continuous access to the Site, but is under no obligation to do so. The company may therefore interrupt access to the Site, particularly for maintenance or updating reasons, or for any other reasons, especially technical or editorial, without prior notice or information to users, and without being liable for the consequences of these interruptions for users or any third party.

Furthermore, the company cannot be held responsible if users are unable to access all or part of the Site due to any technical defect or problem, including but not limited to:

  • Internet network failure and/or congestion,
  • Failure of internet service providers,
  • Human or electrical error,
  • Any malicious intervention,

General Terms and Conditions of Sale

INTRODUCTION

1.1 The Site allows the reservation of rooms and additional services at the Maison Mère hotel (hereinafter the "Hotel") by clients.

1.2 These general terms and conditions of sale (the "General Terms and Conditions of Sale") apply to the reservation of rooms and additional services at the Hotel (the "Services") and are those in effect on the date of confirmation of your reservation on the Site. They cancel and replace any previously online and/or accepted general terms and conditions of sale by the Client.

1.3 Any reservation on the Site requires the consultation and unreserved acceptance of the General Terms and Conditions of Sale. It is recommended to download and/or print the General Terms and Conditions of Sale to keep a copy on the day of a reservation, as they may be subject to modifications. However, any modification occurring after the confirmation of a reservation cannot be applied to that reservation.

1.4 The Client's acceptance of the General Terms and Conditions of Sale and the conditions, particularly financial, of each reservation made is carried out by proceeding with the reservation "By choosing to book, I acknowledge that I have read and accepted the General Terms and Conditions of Sale and the Privacy Policy of Maison Mère" or any other similar box proposed on the Site.

1.5 The Client acknowledges having all necessary information on the Site, which includes in particular: the complete contact details of the Hotel, which can be consulted in the "General Conditions of Use of the Site" section, the main and essential characteristics of the accommodations and additional services offered to clients, these General Terms and Conditions, the specific conditions applicable to each offer and/or accommodation and/or additional service(s) and the Privacy Policy, the price of the accommodations and additional services offered to clients, the maximum number of accommodations that can be reserved by a Client, the accepted payment methods and means, the duration of the contract concluded between the client and the Hotel.

1.6 The term "Client(s)" refers to any natural person who places an order on the Site, as a consumer, for private or professional purposes, but without any connection to the hotel industry.

1.7 As a consumer, the Client benefits from rights that may be challenged if the Services are reserved by him/her in the context of a professional, commercial, industrial, craft, or liberal activity.

1.8 Only Clients (i) who have reached the age of majority (eighteen in most countries) and (ii) who have the legal capacity to enter into contracts, are authorized to order Services on the Site.

1.9 The information provided by the Site is presented in French, as well as in English.

 

2. PURPOSE

2.1 The General Terms of Sale define the terms and conditions applicable to online booking of Services on the Site.

2.2 The General Terms of Sale do not govern the offer, booking, or ordering of Services offered by entities other than Maison Mère and on other websites and/or mobile applications. We recommend, before confirming any order of Services through third-party websites or mobile applications, to check their general terms of sale, as Maison Mère cannot be held responsible for the provision of Services offered by third parties.

2.3 The General Terms of Sale apply to all stages of booking Services by the Client and to the follow-up of their booking.

 

3. BOOKING

3.1 The Site offers an online booking process for hotel rooms for a maximum of four (4) rooms per booking, as well as additional services.

3.2 The accommodation offers presented on the Site include an information sheet containing: if applicable, the type of commercial offer applicable (for example: "Book now and pay less", "Last minute promotion -10%", "Flexible rate", "Room and breakfast", "Your birthday at the hotel"…), a description of the room(s) concerned, the ancillary services included in the offer, the cancellation and modification conditions applicable to the booking, if applicable, the specific terms of sale, the payment terms and conditions, the General Terms of Sale.

3.3 The Site occasionally offers commercial offers that are only accessible on the Site, to the exclusion of any other third-party sites, such as temporary offers named "Best guaranteed offers". If applicable, the Client is invited to consult the specific conditions applicable to these offers, which are brought to their attention at the time of booking. These commercial offers can be modified at any time by Maison Mère, which is only contractually bound by the bookings validated by the Client and cannot be held responsible for the modification or withdrawal of a commercial offer on the Site.

3.4 The Client selects the Services offered on the Site. They are solely responsible for the choice of Services and their suitability for their needs, so Maison Mère's liability cannot be engaged in this regard.

3.5 The Client can book a maximum of four (4) rooms on the Site. For any booking of more rooms or for any other service request not appearing on the Site, we invite you to contact Maison Mère directly. In case of booking five (5) or more rooms, group conditions may apply, requiring the Client to pay a deposit and applying specific cancellation and modification conditions. For any information in this regard, please contact Maison Mère.

3.6 The booking is deemed accepted by the Client at the end of the booking process.

3.7 The Client certifies the truthfulness and accuracy of the information provided when booking Services. Maison Mère reserves the right not to follow up on any booking made by a person who fraudulently uses the Site or who does not comply with these General Terms of Sale.

 

4. BOOKING PROCESS

4.1 Bookings are made by the Client using a dematerialized booking form accessible on the Site.

4.2 During the booking, the Client must provide certain mandatory data, including some personal data necessary for the processing of the booking by Maison Mère, which reserves the right to refuse any booking in the absence of this data or due to its erroneous nature. The Client must also indicate the number of people benefiting from the Services, as well as their age, with any minor over 13 years old being considered an adult.

4.3 The booking procedure on the Site includes the following steps:

  • Step 1: Selection on the homepage of the Site www.maisonmere.co, of the arrival date,
  • Step 2: Opening of a secure page indicating the available offers for the selected Hotel and date, offering the Client the possibility to specify or modify any of the choices made (arrival and departure dates, number of room(s), number of people...),
  • Step 3: Consultation and selection of an offer,
  • Step 4: Selection, if applicable, of one or more additional Services,
  • Step 5: Verification of the booking details, its total price, and the applicable conditions, and possible modification of the choices made,
  • Step 6: Provision by the Client of their contact details,
  • Step 7: Entry of bank details in case of request for guarantee or prepayment,
  • Step 8: Consultation and acceptance of the General Terms of Sale, the Privacy Policy, and, if applicable, the specific terms of sale before the validation of the booking by the Client,
  • Step 9: Validation of the booking by the Client.

 

5. BOOKING CONFIRMATION

5.1 The Site acknowledges receipt of the booking made by the Client by sending an email containing (i) the corresponding booking number, (ii) the summary of the booking including the reserved Services, the price of the Services, the terms of sale applicable to the selected rate, accepted by the Client, (iii) the General Terms of Sale, if applicable, information regarding after-sales service, and the contact address for complaints.

5.2 The booking is considered firm and final upon receipt of this booking confirmation email sent by Maison Mère to the Client.

5.3 The duration of the contract concluded between the Client and the Hotel corresponds to the duration of the accommodation Service provided by the booking.

 

6. CANCELLATION OR MODIFICATION OF A BOOKING BY THE CLIENT

6.1 In application of Article L.221-28 of the Consumer Code, the Services offered on the Site do not allow the exercise of the right of withdrawal provided for in Articles L.221-18 and following of the Consumer Code regarding distance selling contracts.

6.2 The terms of sale for the reserved rate specify the conditions for cancellation and/or modification of the booking.

6.3 Bookings with prepayment cannot be modified and/or canceled. The amounts paid in advance constitute a deposit and cannot be refunded, as indicated in the terms of sale for the rate brought to the Client's attention and accepted by them.

6.4 When the cancellation of a booking is possible, the client must directly contact the hotel's customer service. Contact information can be found on the Hotel's Site.

6.5 Some commercial offers on the Site have specific conditions for cancellation and modification of the booking, which are detailed in their Specific Terms included in the offer's descriptive sheet.

6.6 Unless otherwise specified, cancellation or modification of a booking is possible without charge only within a minimum period of 48 hours before the scheduled arrival time. For any cancellation occurring less than 48 hours before the arrival time, a penalty night will automatically be charged to the Client's credit card provided at the time of booking.

6.7 To modify a booking on the Site, the booking must be canceled under the aforementioned conditions, and a new booking must be made.

 

7. NO SHOW AND INTERRUPTION OF STAY

7.1 Any reservation made on the Site includes a check-in time at 3:00 PM and a check-out time at 12:00 PM. The Client must check in at the Hotel before 6:00 PM or notify the hotel in case of late arrival. If the Client does not check in at the Hotel by 6:00 PM, one night's penalty will automatically be charged to the Client's credit card provided at the time of booking, except in the case of prepayment for the reservation on the Site.

7.2 If the reserved room is vacated after the required check-out time (12:00 PM), an additional night will be charged to the Client as a penalty.

7.3 Any interruption of the stay before the scheduled departure date in the reservation will result in the payment of the full agreed price.

8. PRICE OF SERVICES

8.1 The price of the Services is indicated on the Site before the reservation on the offer description sheet, as well as during the reservation process.

8.2 The indicated rates are per room, for the number of people indicated, according to the selected period, and include only the Services strictly mentioned in the reservation.

8.3 The price of each Service is indicated inclusive of all taxes (TTC), excluding tourist tax, and details the amount of VAT applicable to the Service.

8.4 The euro is the currency used for reservations, so payment must be made in this currency. Prices displayed on the Site in different currencies are for estimation purposes and do not accurately reflect the amount to be paid, which is indicated in euros when the reservation is confirmed by the Client.

8.5 The prices mentioned on the Site are subject to change at any time by Maison Mère, without prior notice. Only the price indicated in the reservation confirmation is contractual.

 

9. PAYMENT

9.1 Unless otherwise specified, the payment of the price of the Services is made at the Hotel, at the end of the stay. In case of prepayment, the amounts paid constitute a deposit and cannot be refunded to the Client.

9.2 In case of no-show at the Hotel or late cancellation resulting in a penalty night, the Client's bank details provided at the time of booking will be used for the payment of the corresponding penalties.

 

10. STAY AT THE HOTEL

10.1 In accordance with current French regulations, the Client may be asked to fill out a police form upon arrival at the Hotel. To verify whether the Client is subject to this requirement, an identity document will be requested.

10.2 The Maison Mère hotel welcomes certain animals as long as they are kept on a leash or in a cage in the common areas of the establishment. For more information on these reception conditions, it is recommended that the Client directly contact the Hotel. During the entire stay, the animal remains the sole responsibility of the Client.

10.3 During the stay, the Client agrees to use the rented room reasonably and responsibly. The Hotel may ask the Client to leave the Hotel without any compensation being paid and to pay the full reserved Service, particularly in the case of behavior contrary to good morals or public order, any damage, degradation, or act of vandalism caused by the Client or his/her agents or persons under his/her responsibility, during the occupation of the premises, to any movable or immovable property, furnishings, decoration, or any other nature present in the Hotel. Moreover, the Client will be required to fully reimburse the damages caused by his/her actions, and Maison Mère reserves the right to take any necessary actions to obtain compensation for the suffered damage.

10.4 Maison Mère provides Clients with free Wi-Fi internet access throughout the Hotel. The Client agrees that the computing resources made available will not be used for fraudulent or illegal purposes, especially to commit any act of counterfeiting third-party rights and/or illegal downloading of works protected by copyright or neighboring rights, punishable under Article L.335-2 of the Intellectual Property Code.

 

11. RELOCATION – FORCE MAJEURE

11.1 In case of unavailability of the reserved room within a Hotel, Maison Mère reserves the right to accommodate the Client, in whole or in part, in a Hotel of equivalent or superior category and offering similar Services. The transfer will be entirely at the expense of Maison Mère, without any additional charges being requested from the Client by the Hotel.

11.2 Maison Mère will be released from all responsibility for the non-fulfillment of its obligations in case of events qualifying as force majeure, for the duration of the force majeure event, and commits to make all reasonably necessary efforts to limit the effects.

11.3 For the purposes of this Article, force majeure is understood as any event or circumstance that the parties could not reasonably foresee and control at the time of booking due to its external, unpredictable, and irresistible nature. Such events include, but are not limited to, those recognized by French courts and tribunals, total or partial strikes, internal or external to the Hotel, terrorism, wars or uprisings, bad weather, epidemics, blockage of means of transport or supply for any reason, earthquake, fire, storm, flood, water damage, computer system failure paralyzing the normal continuation of a Party's activities.

 

12. PERSONAL DATA

12.1 In accordance with law No. 2018-493 of June 20, 2018, on the protection of personal data and the General Data Protection Regulation No. 2016/679 (GDPR), the Client is informed that the information provided during the reservation has been subject to personal data processing for the management of reservations and Clients, billing and payment needs, as well as for commercial prospecting purposes.

12.2 The Client is also informed that the hotel has a video surveillance system within the common areas of the building for the safety of people and property.

12.3 The Client has the right to access, rectify, transfer, and delete personal data concerning him/her, which he/she can exercise with Maison Mère by writing to the following email address: hello@maisonmere.co.

12.4 The Client can obtain information on how Maison Mère processes his/her personal data by consulting the Privacy Policy or by sending a request to the following email address: hello@maisonmere.co or to our head office address: 7 rue Mayran, 75009 Paris (France).

12.5 The Client can use the Bloctel service, a free service that allows the registration of his/her number, that of his/her spouse or children, to oppose telephone solicitation on these numbers. Decree No. 2022-1313 of October 13, 2022, provides that from March 1, 2023, telephone solicitation of consumers will be allowed only from Monday to Friday, from 10 a.m. to 1 p.m. and from 2 p.m. to 8 p.m. It will be prohibited on Saturdays, Sundays, and public holidays. This regulation will apply both to persons not registered on the "Bloctel" telephone solicitation opposition list and to those registered but solicited under an ongoing contract. 13. MEDIATION - JURISDICTION

13.1 In case of a dispute existing after referring to the establishment at the address hello@maisonmere.co and without a satisfactory response within up to 1 year, the client can contact the European Mediators Association, whose contact details are as follows:

13.2 The platform https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&Ing=FR can be used for online dispute resolution.

 

14. GENERAL PROVISIONS

14.1 The General Terms of Sale are regularly modified, particularly considering regulatory changes. The new General Terms of Sale will apply on their publication date on the Site.

14.2 The General Terms of Sale, including the Privacy Policy, the General Terms of Use of the Site, and, if applicable, the specific conditions applicable to certain offers, constitute the entire contract concluded between the Client and Maison Mère concerning his/her reservation on the Site and supersede all previous general terms of sale.

14.3 In the event that any provision of these General Terms of Sale is declared null or void, in whole or in part, for any reason, the other provisions will remain in effect.
