INTRODUCTION 1.1 The website allows customers to make reservations for rooms and additional services at the Maison Mère Hotel (hereinafter referred to as the "Hotel").
1.2 These general terms and conditions of sale (the "General Terms and Conditions of Sale") apply to the reservation of rooms and additional services at the Hotel (the "Services") and are in effect on the date of confirmation of your reservation on the Site. They cancel and replace any previously published and/or accepted general terms and conditions of sale by the client.
1.3 Any reservation on the website requires the consultation and unconditional acceptance of the General Terms and Conditions of Sale. It is recommended to download and/or print the General Terms and Conditions of Sale in order to keep a copy on the day of a reservation, as they may be subject to changes. However, any modification made after the confirmation of a reservation cannot be applied to that reservation.
1.4 The Client's acceptance of the General Terms and Conditions of Sale and the conditions, including financial conditions, of each reservation is made by proceeding with the reservation, stating "By choosing to make a reservation, I acknowledge having read and accepted the General Terms and Conditions of Sale and the Privacy Policy of Maison Mère" or any similar checkbox provided on the Site.
1.5 The Client acknowledges having all the necessary information on the Site, including: the complete contact details of the Hotel, which can be found in the "General Conditions of Site Use" section, the main and essential characteristics of the accommodations and additional services offered to customers, these General Terms and Conditions, the specific conditions applicable to each offer and/or accommodation and/or additional service(s), and the Privacy Policy, the rates of the accommodations and additional services offered to customers, the maximum number of accommodations that can be reserved by a Client, the accepted payment methods, the duration of the contract concluded between the client and the Hotel.
1.6 The term "Client(s)" refers to any natural person who places an order on the Site, as a consumer, for private or professional purposes, but unrelated to the hotel industry.
1.7 As a consumer, the Client has rights that may be affected if the Services are reserved by him/her in the course of a professional, commercial, industrial, artisanal, or liberal activity.
1.8 Only Clients (i) who have reached the age of majority (eighteen in most countries) and (ii) who have the legal capacity to enter into contracts are authorized to order Services on the Site.
1.9 The information provided by the Site is presented in both French and English.
PURPOSE 2.1 The General Terms and Conditions of Sale define the terms and conditions applicable to the online reservation of Services on the website.
2.2 The General Terms and Conditions of Sale do not govern the offer, reservation, or order of Services offered by entities other than Maison Mère and on other websites and/or mobile applications. Before confirming any order for Services through third-party websites or mobile applications, we recommend checking their general terms and conditions of sale, as Maison Mère cannot be held responsible for the provision of Services offered by third parties.
2.3 The General Terms and Conditions of Sale apply to all stages of the reservation of Services by the Client and to the follow-up of their.
RESERVATION PROCESS 3.1 The reservation of Services on the Site is subject to the following steps:
(a) Selection of the desired date(s), number of rooms, and number of guests.
(b) Selection of the desired room category and additional services, if applicable.
(c) Verification and validation of the reservation details, including the total price of the reservation, applicable taxes, and any additional charges.
(d) Completion of the Client's personal information, including full name, contact details, and payment information.
(e) Review and acceptance of the General Terms and Conditions of Sale and the Privacy Policy.
(f) Confirmation of the reservation by clicking on the "Book Now" or similar button.
3.2 After the reservation is confirmed, the Client will receive an email confirmation containing the reservation details and a summary of the General Terms and Conditions of Sale.
PRICES AND PAYMENT
4.1 The prices displayed on the Site are quoted in Euros and include all taxes and fees applicable at the time of reservation, unless otherwise stated.
4.2 The Client agrees to pay the total amount of the reservation, including the room rate and any additional services, as specified during the reservation process.
4.3 Payment for the reservation can be made by credit card or any other payment method accepted by Maison Mère. The Client must provide accurate and valid payment information at the time of reservation.
4.4 Maison Mère reserves the right to pre-authorize or charge the Client's credit card before the arrival date, in accordance with the reservation and cancellation policy.
CANCELLATION AND MODIFICATION
5.1 The cancellation and modification policy for reservations may vary depending on the room category, rate plan, and specific conditions chosen by the Client. The applicable policy will be clearly indicated during the reservation process.
5.2 In case of cancellation or modification, the Client must notify Maison Mère directly, either by phone or email, using the contact information provided on the website.
5.3 Depending on the cancellation or modification policy, the client may be subject to fees or charges. The specific terms and conditions will be communicated to the client at the time of reservation.
LIABILITY AND MAJOR FORCE
6.1 Maison Mère undertakes to provide the services with reasonable skill and care, in accordance with the descriptions and specifications provided on the Site.
6.2 Maison Mère will not be liable for any damages or losses resulting from events beyond its control, including but not limited to acts of God, natural disasters, strikes, government actions, or any other circumstances that are unforeseeable or unavoidable.
6.3 Maison Mère's liability for any damages or losses arising from the provision of the services shall be limited to the total amount paid by the client for the reservation.
APPLICABLE LAW AND JURISDICTION
7.1 These General Terms and Conditions of Sale are governed by and construed in accordance with French law.
7.2 In the event of a dispute arising out of or in connection with the reservation of services, the client and Maison Mère agree to submit to the exclusive jurisdiction of the courts of Paris, France.
7.3 Any interruption of the stay before the scheduled departure date in the reservation will result in the payment of the full agreed price.
PRICE OF SERVICES
8.1 The price of the services is indicated on the website before booking on the offer's description page, as well as during the booking process.
8.2 The prices indicated are per room, for the specified number of people, according to the selected period, and only include the services strictly mentioned in the reservation.
8.3 The price of each service is indicated inclusive of all taxes (VAT), excluding the city tax, and details the amount of VAT applicable to the Service.
8.4 The euro is the commercial currency of the reservation, so payment must be made in this currency. Prices displayed on the website in different currencies are estimates and do not accurately reflect the amount to be paid, which is indicated in euros at the time of reservation confirmation by the client.
8.5 The prices mentioned on the website are subject to change at any time by Maison Mère, without prior notice. Only the price indicated in the reservation confirmation is contractual.
PAYMENT OF PRICE
9.1 Unless otherwise specified, the payment of the price of the services is made at the hotel upon check-out. In the case of prepayment, the amounts paid are considered as deposits and cannot be refunded to the client.
9.2 In case of no-show at the hotel or late cancellation resulting in a penalty night, the client's bank details provided at the time of reservation will be used for the settlement of the corresponding penalties.
HOTEL STAY
10.1 In accordance with French regulations, the client may be asked to fill out a police form upon arrival at the hotel. To determine if the client needs to complete this form, an identification document will be requested.
10.2 Maison Mère hotel allow certain animals as long as they are kept on a leash or in a cage in the common areas of the establishment. For more information on these conditions, it is advisable for the client to contact the hotel directly. During the entire stay, the animal remains under the full responsibility of the client.
10.3 During the stay, the client undertakes to use the rented room in a reasonable manner and as a good family member. The hotel may ask the client to leave the premises without any compensation and to pay the full price of the reserved service, particularly in the event of behavior contrary to morals or public order, any damage, degradation, vandalism caused by the client or their employees or persons under their responsibility, during the occupancy of the premises, to any furniture or property, decoration, or any other item present in the hotel. In addition, the client will be required to fully reimburse the damages caused by their actions, and Maison Mère has the right to take any necessary action to obtain compensation for the damage suffered.
10.4 Maison Mère provides clients with WiFi internet access throughout the hotel. The client undertakes not to use the computer resources made available for fraudulent or illegal purposes, including the infringement of third-party rights and/or illegal downloading of works protected by copyright or neighboring rights, as sanctioned by Article L.335-2 of the Intellectual Property Code.
EVACUATION - MAJOR FORCE
11.1 In the event that the reserved room is unavailable at a hotel, Maison Mère reserves the right to accommodate the client, in whole or in part, in a hotel of equivalent or higher category offering similar services. The transfer will be entirely covered by Maison Mère, without any additional costs being charged to the client by the Hotel.
11.2 Maison Mère will be relieved of any liability for the non-performance of its obligations in the event of major force, for the duration of the major force event, and agrees to inform the client as soon as possible.
11.3 In the event of an evacuation of the hotel due to a force majeure event or for any other reason beyond the control of Maison Mère, the client agrees to comply with the instructions given by the hotel staff and to leave the premises without delay.
LIABILITY
12.1 Maison Mère is not liable for any inconvenience or damage arising from the use of the Internet, including a service interruption, an external intrusion, or the presence of computer viruses.
12.2 Maison Mère is not liable for any loss, theft, or damage to personal belongings and valuables belonging to the client during their stay at the hotel.
12.3 The client is responsible for any damage caused by them, their employees, or persons under their responsibility to the premises, furniture, equipment, or any other item belonging to Maison Mère. The client agrees to pay for any repairs or replacement costs required as a result of such damage.
PERSONAL DATA
13.1 The personal data collected during the reservation process is necessary for the management of the reservation and the provision of the services by Maison Mère. This data may also be used for commercial prospecting purposes, subject to the client's agreement.
13.2 Maison Mère ensures the confidentiality and security of personal data in accordance with applicable data protection laws. The client has the right to access, rectify, and delete their personal data, as well as the right to object to the processing of their data for commercial prospecting purposes.
APPLICABLE LAW AND JURISDICTION
14.1 These General Terms and Conditions are subject to French law.
14.2 In the event of a dispute relating to the interpretation, validity, or execution of these General Terms and Conditions, the parties agree to attempt to resolve the dispute amicably. If no amicable agreement is reached, the dispute will be submitted to the competent French courts.
